1. Acceptance of Terms

By accessing or using the Art Forge platform ("Platform"), operated by IAMAG ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Platform Description

Art Forge is a crowdfunding platform that enables artists ("Creators") to create and sell art tutorials and related digital content to supporters ("Backers"). The Platform facilitates:

• Campaign creation and funding
• Content delivery and streaming
• Payment processing
• Community engagement

3. User Accounts

3.1 Registration

• You must be 18 years or older to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining account security
• You may not share your account credentials

3.2 Account Types

• Backer Account: For purchasing and accessing content
• Creator Account: For launching campaigns and selling content

3.3 Account Termination

• You may close your account at any time
• We reserve the right to suspend or terminate accounts for Terms violations
• Purchased content access remains available after account closure

4. For Creators

4.1 Campaign Requirements

• Minimum funding goal: $500
• Campaign duration: 30 days (standard), plus 7-day extension after reaching goal
• Artists set their own tier pricing (recommended: $15/$25 for campaign, $20/$30 post-campaign)
• Required content: 45+ minutes of video (streaming only)
• All content must be original or properly licensed
• Content must match campaign description

4.2 Content Standards

• Professional quality (1080p minimum video)
• Clear audio with minimal background noise
• Educational value with clear instruction
• No copyrighted material without license
• No offensive, discriminatory, or harmful content
• No misleading claims or false advertising

4.3 Content Review

• All content subject to IAMAG review before publication
• Review timeline: 3-5 business days
• We reserve the right to reject content not meeting standards
• Revisions may be requested

4.5 Payment Terms

• Payments processed once content is delivered and approved
• Payouts processed within 7 business days of approval
• Minimum payout threshold: $50
• Creator responsible for applicable taxes

4.6 Content License

• You retain ownership of your content
• You grant IAMAG license to host, stream, and distribute content on Art Forge and IAMAG Master Classes Platform
• License is non-exclusive (unless you opt for exclusivity benefits)
• All video content delivered via streaming only; no download option for videos
• You may not remove content from platform while Backers have active access rights

5. For Backers

5.1 Campaign Backing

• Payment processed only if campaign reaches funding goal
• If campaign fails, no charge is made
• No refunds after successful campaign funding
• Campaign prices locked at time of backing

5.2 Content Access

• Lifetime streaming access to purchased content on Art Forge and IAMAG Master Classes Platform
• Project file download rights (Tier 2 only - does not include video files)
• Access from multiple devices permitted
• No sharing or distribution of content
• Videos are streaming-only; no download option

5.3 Refund Policy

• Digital content is non-refundable once delivered
• Technical issues preventing access will be resolved
• Refunds considered only for unresolvable technical problems
• Refund requests must be made within 14 days

5.4 Prohibited Uses

• No unauthorized copying or distribution
• No reverse engineering or extraction
• No screen recording or capturing of streaming videos
• No commercial use without separate licensing
• No uploading to file-sharing or torrent sites
• Project files (Tier 2) for personal use only

6. Payment Processing

6.1 Payment Provider

• All payments processed via Stripe
• Subject to Stripe's Terms of Service
• Payment information not stored on our servers

6.2 Fees

• All prices displayed in USD
• Payment processing fees included in platform fee
• No hidden charges to Backers

6.3 Taxation

• Creators responsible for income taxes
• EU VAT applied where applicable
• Tax documentation provided annually

7. Intellectual Property

7.1 Platform Content

• IAMAG retains all rights to Platform design, code, and branding
• Platform name, logo, and marks are IAMAG trademarks

7.2 User Content

• Creators retain ownership of uploaded content
• Creators grant IAMAG necessary licenses for platform operation
• Backers receive limited license for personal use only

7.3 Copyright Infringement

• We respect intellectual property rights
• DMCA takedown process available
• Repeated infringement results in account termination

8. Prohibited Activities

You may not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Harass, abuse, or harm others
• Manipulate campaigns or engage in fraud
• Create fake accounts or reviews
• Scrape or data mine the Platform
• Circumvent security measures

9. Content Moderation

9.1 Review Rights

• IAMAG reserves the right to review all content
• We may remove content violating these Terms
• We may remove content for legal compliance

9.2 User Reports

• Users may report inappropriate content
• Reports reviewed within 48 hours
• Action taken on verified violations

10. Disclaimers

10.1 Platform Provided "As Is"

• No warranties of any kind
• No guarantee of uninterrupted service
• No guarantee of error-free operation

10.2 Content Accuracy

• IAMAG does not guarantee accuracy of Creator content
• Creators responsible for content accuracy
• Educational results not guaranteed

10.3 Third-Party Services

• Platform integrates with third-party services (Stripe, etc.)
• Not responsible for third-party service failures
• Subject to third-party terms

11. Limitation of Liability

11.1 Indirect Damages

• IAMAG not liable for indirect, incidental, or consequential damages
• Including lost profits, data loss, or business interruption

11.2 Maximum Liability

• Total liability limited to amount paid by user in past 12 months
• Minimum liability: $100

11.3 Exceptions

• Limitations do not apply where prohibited by law
• Does not limit liability for fraud or willful misconduct

12. Indemnification

You agree to indemnify and hold harmless IAMAG from:

• Your violations of these Terms
• Your content infringing third-party rights
• Your use of the Platform
• Your violation of laws or regulations

13. Dispute Resolution

13.1 Arbitration

• Disputes under $10,000 subject to binding arbitration
• Arbitration conducted in English
• Class action waiver applies

13.2 Creator-Backer Disputes

• IAMAG not responsible for disputes between Creators and Backers
• Users encouraged to resolve directly
• Platform may suspend accounts involved in disputes

14. Privacy

14.1 Data Collection

• We comply with GDPR and CCPA
• You control your personal data

• Platform uses cookies for functionality

15. Changes to Terms

15.1 Modification Rights

• We may modify these Terms at any time

• Continued use constitutes acceptance

16. General Provisions

16.1 Entire Agreement

• These Terms constitute entire agreement
• Supersedes all prior agreements

16.2 Severability

• Invalid provisions do not affect remaining Terms
• Invalid provisions replaced with valid equivalent

16.3 No Waiver

• Failure to enforce Terms is not waiver
• Waivers must be in writing

16.4 Assignment

• You may not assign rights under these Terms
• We may assign to affiliates or successors

By using the Art Forge Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
